1.1. These Terms (hereinafter – the Terms) determine the procedure for using the portal Sveikt.lv (hereinafter – the Portal). The Terms are binding on all persons who use the Portal, register on it, create or order video greetings through the Portal.
1.2. The portal is maintained and administered by SIA ‘Sveikt’, reg. No. 40203356641, legal address: Liepājas Street 49 – 6, Kuldīga, Kuldīgas nov., LV-3301, e-mail address: info@sveikt.lv (hereinafter – ‘Welcome’, ‘we’, ‘us’) …
1.3. By confirming these Terms or registering their profile on the Portal, the user agrees to these Terms of Use and other binding terms published on the Portal.
1.4. In order to order a video greeting from one of the personalities, the user needs to create their profile on the Portal, providing the necessary information. It is also possible to log in and enter the Portal with one of the previously created Facebook.com, Draugiem.lv, Google accounts or Apple accounts.
2. Users of the portal are prohibited from:
2.1. to use Draugiem.lv or Facebook.com user profile, which has been created or is used contrary to the terms of use of social networks;
2.2. use uncensored, defamatory texts in the ordering process or in correspondence with personalities and / or the administration of the portal in any language and manner, as well as in any way unreasonably insult other users and the administration;
2.3. to express phrases insulting human dignity, race, religion in the ordering process or in correspondence with personalities and / or portal administration in any language and form;
2.4. to perform any kind of activities that hinder the full use of the portal by other users;
2.5. Perform any kind of activities related to the advertising of third party products or services on the Portal without prior approval of the Portal administration.
3. Portal administration
3.1. The task of the portal administration is to offer the possibility to create a user account, place a video greeting order and monitor its fulfillment, as well as to respond to user reports submitted in one of the available means of communication.
3.2. It is possible to contact the administration using the communication contact form, as well as by writing to the e-mail info@sveikt.lv.
3.3. In case of violation of the Rules, the Administration of the Portal reserves the right to block the user’s access to the Portal without prior notice.
3.4. In case of blocking the user, the previously reserved or paid money will not be refunded in any way.
4. Paid services
4.1. It is possible to order a video greeting from each person registered on the portal and in active status for a certain price. The price depends on the order execution time (normal or express) and is determined individually by each person.
4.2. If the user chooses to place an order, it is possible to receive the prepared video after prepayment for the respective service.
4.3. All prices are in euros and include value added tax.
4.4. You can pay for your video greeting using one of the available payment methods.
4.5. The user may make payments only from his own payment card or account; it is strictly prohibited to use a payment instrument belonging to a 3rd person without prior coordination with that person.
5. Privacy
5.1. To order a video greeting from one of the personalities offered on the Portal, you need to register and create your profile.
5.2. You can create a profile by filling in the required information and registering, or by logging in with a social networking profile.
5.3. When a payment is made, we process the information associated with such transactions.
5.4. We receive information about the devices you use to access the Site (such as the type of device, operating system, web browser, mobile operator, IP address, connection time and duration).
5.5. We receive information from third-party websites and mobile applications that you use when you log in to the Portal (for example, authorize with Draugiem.lv or Facebook passport).
5.6. We use cookies.

Rīga, 2022.gada 4.novembrī
SIA „Sveikt”, vien. reģ. Nr. 40203043894, juridiskā adrese Liepājas iela 49 - 6, Kuldīga, Kuldīgas nov., LV-3301, kuru uz statūtu pamata pārstāv valdes priekšsēdētājs Andris Garkalns (turpmāk tekstā – Pasūtītājs), no vienas puses un
Vārds, uzvārds, p.k. 000000-11111, adrese: XXXXXX iela X-Y, LV-XXXX, Rīga (turpmāk tekstā – Autors), no otras puses, abi kopā un atsevišķi sauktas Līdzēji, no brīvas gribas bez spaidiem, maldiem un viltus noslēdz autoratlīdzības līgumu (turpmāk tekstā - Līgums) par sekojošo:
1. LĪGUMA PRIEKŠMETS
1.1. Autors apņemas saskaņā ar Pasūtītāja norādījumiem izpildīt (izstrādāt) individuāli veidotu apsveikumu (turpmāk tekstā – Autordarbs). Ar apsveikumu tiek saprasts individuāli sagatavots apsveikums video formātā un kura garums ir vismaz 15 (piecpadsmit) sekundes. Pasūtītājs apņemas samaksāt autoratlīdzību Līgumā noteiktajā kārtībā un apjomā.
1.2. Autordarba izstrāde tiek veikta video formātā, kas tiek sagatavots un iesniegts Pasūtītājam apstiprināšanai un nosūtīšanai apsveikuma adresātam.
1.3. Radot Autordarbu, Autors ņem vērā Pasūtītāja nolūkus attiecībā uz tā izmantošanu.
1.4. Pasūtītājs nosūta pasūtījumu un tā detaļas uz Autora e-pasta adresi.
1.5. Autors __________ (piekrīt/nepiekrīt), ka Pasūtītājs var izmantot sagatavoto Autordarbu reklāmas nolūkos (piemēram – reklāmas materiālu radio, televīzijā vai interneta vidē).
2. AUTORA TIESĪBAS UN PIENĀKUMI
2.1. Autors apliecina, ka tam ir nepieciešamās pilnvaras un tiesības, lai uzņemtos un pildītu šajā Līgumā noteiktās saistības, kā arī garantē to personīgu izpildi.
2.2. Autors apstiprina vai noraida Pasūtītāja veikto pasūtījumu, rakstiski atbildot uz Pasūtītāja e-pastu, no kura ir saņemts konkrētais pasūtījums.
2.3. Autors apņemas pēc Pasūtītāja pasūtījuma izveidot Autordarbu: individuālu video sveicienu, kas ilgst vismaz 15 sekundes un ir MP4 vai MOV formātā.
2.4. Autordarbs tiek sagatavots 1 (vienas) dienas laikā (ātrais pasūtījums) vai līdz 5 (piecu) dienu laikā (parasts pasūtījums) laikā no Pasūtījuma veikšanas brīža.
2.5. Sagatavotais autordarbs tiek nosūtīts uz Pasūtītāja e-pasta adresi, un izpildes termiņš tiek skaitīts no dienas, kad Autordarbs ir saņemts Pasūtītāja epastā.
2.6. Autors garantē, ka Autordarba radīšanā nav nesankcionēti izmantotas vai citādi aizskartas trešo personu autortiesības. Pasūtītājs nenes nekādu atbildību pret trešajām personām šajā sakarā.
2.7. Autors nav tiesīgs bez Pasūtītāja atsevišķas rakstveida atļaujas Autordarbu nodot jebkurai trešajai personai jebkādai izmantošanai.
2.8. Autors uzņemas atbildību Pasūtītāja vietā par zaudējumiem, kas var rasties Pasūtītājam vai trešajām personām, ja trešās personas ceļ pretenzijas par Autora darba vai tā atsevišķu fragmentu autorību.
2.9. Autors uzņemas atbildību par Pasūtītāja zaudējumiem, kuri Pasūtītājam var rasties gadījumā, ja Autors izmanto savas autora personiskās tiesības uz darba atsaukšanu vai pretdarbību.
3. PASŪTĪTĀJA TIESĪBAS UN PIENĀKUMI
3.1. Pasūtītāja pienākums ir nodot Autoram informāciju par nepieciešamo pasūtījuma izveidi, kā arī kāda konkrēta informācija ir jāiekļauj konkrētajā Autordarbā. Šī informācija tiek nodota ar e-pasta starpniecību, nosūtot to uz Autora norādīto e-pastu.
3.2. Pasūtītājs apņemas sagatavoto Autordarbu neizmantot komerciāliem nolūkiem, lai reklamētu ar Sveikt.lv nesaistītus produktus vai pakalpojumus.
3.3. Pasūtītājs apņemas Autordarbus aizsargāt ar Sveikt.lv ūdenszīmi, ko nedrīkst noņem.
3.4. Pasūtītājs apņemas izmaksāt Autoram autoratlīdzību par Autordarba izveidošanu un saņemto atļauju un tiesībām izmantot Autordarbu.
3.5. Par Līgumam atbilstošu Autordarba izpildi tiek atzīts ar pasūtījuma apstiprināšanu Sveikt.lv platformā, ja tajā nav konstatēti trūkumi un noteikts termiņš trūkumu novēšanai.
3.6. Pasūtītājam ir tiesības atteikties vai lūgt Autoru pārveidot sagatavoto Autordarbu, ja tas ir sagatavots nekvalitatīvi un/vai iekļautā informācija neatbilst Pasūtītāja iesūtītā pasūtījuma aprakstam.
4. SAMAKSAS KĀRTĪBA
4.1. Autoram par Līguma 1.1. punktā noteiktā Autordarba izveidošanu pienākas autoratlīdzība. No saņemtās autoratlīdzības nodokļus likumā noteiktā apjomā un kārtībā apņemas maksāt pats Autors.
4.2. Līdzēji vienojas, ka no nolīgtās un saņemtās Autoratlīdzības, Pasūtītājs kā sveikt.lv platformas īpašnieks ietur 30% un Autoram izmaksā 70% no nolīgtās un saņemtās autoratlīdzības.
4.3. Autoram izmaksājamā autoratlīdzības daļa ir EUR 00,00 (00 euro un 00 centi) (ātrais pasūtījums) un EUR 00,00 (00 euro un 00 centi) (parasts pasūtījums).
4.4. Autoratlīdzība tiek izmaksāta uz Autora norādīto bankas kontu katra kalendārā mēneša 1.datumā, ja kopējais uzkrātais (neizmaksātais) apjoms ir vismaz EUR 50,00 (50 euro un 00 centi).
4.5. Par samaksas dienu tiek uzskatīta diena, kad Pasūtītājs naudu ir pārskaitījis no sava bankas konta.
4.6. Pasūtītājs ir tiesīgs ieturēt Autoratlīdzību, ja Autors nav iesniedzis Autordarbu noteiktā termiņā un/vai nav novērsis trūkumus, kas konstatēti Pasūtītājam saņemot Autora izveidoto Autordarbu.
4.7. Pasūtītājs ir tiesīgs piemērot līgumsodu 0,5% no pielīgtās Autoratlīdzības summas par katru nokavēto kalendāro dienu.
4.8. Pasūtītājs ir tiesīgs izbeigt līgumu pirms termiņa, ja Autors nokavē darbu izpildi vairāk par 14 dienām.
5. KONFICENCIALITĀTE
5.1. Līdzēji vienojas, ka visa informācija par Līdzēju esošajiem un potenciālajiem pasūtījumiem, to saturu, apjomu, Līdzēju darba kārtību, metodiku, darba apmaksas kārtību, kā arī cita veida informācija, kas iegūta Pasūtītāja un Autora sadarbības laikā un kura attiecas uz Pasūtītāju, Autoru, un nav publiski pieejama trešajām personām, ir stingri konfidenciāla (turpmāk tekstā - Konfidenciālā informācija).
5.2. Līdzēji apņemas neizpaust Konfidenciālo informāciju un nepieļaut tās nodošanu atklātībā bez otra Līdzēja rakstiskas piekrišanas.
5.3. Līdzēji apņemas ievērot šī Līguma konfidencialitātes nosacījumus visu Līguma darbības laiku, kā arī 2 (divus) gadus pēc šī Līguma izbeigšanas.
6. NEPĀRVARAMA VARA
6.1. Neviena no Pusēm nav uzskatāma par vainīgu, ja tā nav spējusi pildīt saistības, kas tai uzliktas ar šo līgumu vai tā sakarā, ja šai Pusei savas saistības nav ļāvuši pildīt jebkādi apstākļi, kas neatrodas tās kontrolē (nepārvaramas varas apstākļi), piemēram, ugunsgrēks, plūdi, eksplozijas, nelaimes gadījumi, ārkārtējs stāvoklis, sacelšanās, karš, streiki vai citi līdzīgas dabas ietekmīgi notikumi vai apstākļi. Jebkuras valsts varas iestādes, vietējas varas iestādes vai starptautiskas organizācijas saistoši rīkojumi, darba strīdi vai blokādes, vai arī piegādātāju nespēja pildīt līguma noteikumus jebkura augšminētā iemesla dēļ ir uzskatāmi par pielīdzināmiem nepārvaramas varas apstākļiem.
6.2. Puse, kas cietusi no nepārvaramas varas apstākļiem, paziņo par to otrai Pusei trīs (3) darba dienu laikā pēc šādu nepārvaramas varas apstākļu iestāšanās un iesniedz ziņojumu ar kompetentas iestādes izsniegtu atsauci, šādā ziņojumā minot augstākminēto apstākļu apstiprinājumu un aprakstu.
6.3. Gadījumā, ja nepārvaramas varas apstākļu rezultātā šis Līgums nav spēkā ilgāk par trim mēnešiem, katrai no Pusēm ir tiesības atteikties no šī Līguma izpildes.
7. LĪGUMA GROZĪŠANA UN IZBEIGŠANA
7.1. Līgums stājas spēkā tā parakstīšanas brīdī un ir spēkā līdz Līdzēju saistību pilnīgai izpildei.
7.2. Līdzēji līgumu var grozīt vai papildināt, rakstiski vienojoties, un šie grozījumi un papildinājumi kļūst par šā Līguma neatņemamu sastāvdaļu.
7.3. Jebkurus strīdus un domstarpības, kas varētu rasties vai radīsies starp Līdzējiem Līguma izpildes laikā, Līdzēji sākotnēji risinās savstarpējo pārrunu ceļā. Ja vienošanās netiek panākta, strīdus jautājums tiek nodots izskatīšanai tiesas ceļā saskaņā ar Latvijas Republikas normatīvajiem aktiem.
7.4. Līdzēji var izbeigt šo Līgumu, rakstveidā vienojoties.
7.5. Šis līgums ir sastādīts uz 3 lappusēm, divos eksemplāros, no kuriem viens eksemplārs – Pasūtītājam, otrs – Autoram.
